英文摘要	随着投资自由化时代的到来,国民待遇条款重获关注。然而,在义务承担方式的选择问题上,各国意见不一。考虑到“否定清单“模式令缔约国所承担的条约义务过高,在未来缔结国际投资协定时,中国应区分外资准入阶段和营运阶段,分别采取“肯定清单“和“否定清单“的模式,以消除准入阶段国民待遇义务所可能带来的不利影响。; With the coming of investment liberalization era,national treatment clauses are widely concerned again.However,states differ in their approaches for the national treatment commitments in IIAs.Given the fact that 'negative list' approach will lead to more treaty agreement's obligations,China should consider a hybrid approach,which is a positive list approach for national treatment regarding pre-establishment and a negative list approach regarding post-establishment in future negotiations,so as to eliminate the adverse impact of the pre-establishment national treatment.; 2011年度国家社会科学基金青年项目(11CFX079); 2012年度厦门大学基础创新科研基金(研究生项目)(201222G006)的阶段性成果
