英文摘要	通过文献分析法、历史分析法、逻辑分析法驳斥了当前体育法学界有关体育法产生的主流观点,即“体育法近代产生说“,指出该说存在的依据是“古代体育法令粗鄙说“。但是对古代罗马法原始文献的发掘证明事实并非如此。体育法并不等同于体育法典,体育法在古代社会就已客观存在,公元前一世纪之前是其萌芽时期,之后便随着罗马法的成熟而步入成熟。“体育法近代产生说“并不成立,“古代体育法令粗鄙说“也最多只能用于描述萌芽阶段的体育法。; Through literature,historical and logical analyses,the paper refutes the current mainstream view about the origin of sports law,which is the theory that sports law originates in modern times.The paper points out that the theory stems from the vulgar nature of ancient sports law,but excavation of the ancient Roman laws has proved that it is not the case.Sports law is different from sports code in that sports law had objectively exited in ancient society.It first emerged before the 1st century BC and gradually became mature with the Roman law.So the theory about the origin of sports law does not hold water,while the vulgar nature of the ancient spots law is merely the description of the sports law in its emerging period.
