| 英文摘要 | 胚胎收养制度,是指胚胎的合法管理人把通过辅助生殖技术制造的剩余体外受精胚胎捐赠给其他不孕夫妇收养,同时让渡胚胎及未来出生儿童的所有权利义务的制度。胚胎收养与传统收养相比,具有成本低、怀孕控制等优势,其收养的条件和程序也具特殊性,它把传统的出生后收养制度推进到出生前的阶段,形成了收养的双轨制,为不孕夫妇组建家庭提供一种新选择。在人工辅助生殖技术业已成熟的背景下,我国可借鉴美国的成功经验和做法,建立完善的胚胎收养制度,这对完善我国家庭和亲权法制,贯彻我国计划生育国策具有十分积极的意义。; Embryo Adoption means an excess embryo made through reproductive technology is relinquished by the legal embryo custodian who holds its legal right and duty to a recipient intended parent,with the acceptance of the right and duty of the baby born in future.Compared with traditional adoption,embryo adoption has the advantages of lower-costs and better pregnancy-controls,and its requirements and procedures of application are also different from the traditional one.With pushing the stage of adoption from the postnatal period to the prenatal period,embryo adoption provides a new choice for the infertile couples to set up a new family,and brings the double-track system of adoption into being.In the background of the rapid development of the artificial reproductive technique,we should establish a more perfect adoption system through learning from the American successful experience of embryo adoption,so that we can improve our law of family and parental right and carry out our national policy of family planning. |
