英文摘要	人人生而平等的命题产生在菲尔麦与经院哲学家贝拉尔米诺和苏亚雷斯的论战中,对西方的公法和私法产生了极大的影响,但在私法领域,它却不能涵盖未成年子女与其父母的关系。形成权理论形成后,人们认识到的私法不平等领域越来越多,继从属劳动关系的屈从性被发现之后,又有房屋租赁关系、附随意条件的合同关系、附随合同关系等加入这类关系的行列,甚至有欺压关系之概念的产生,它们催生了一套调整这种强弱不均衡关系的法律制度,质疑民法调整平等主体间关系的之传统说明的真理性。屈从关系具有保护性,所以,屈从并不等于屈辱。; The proposition that all men are born equally came into being in the debate between Filmer and two scholastics philosophers Bellarmine and Suarez.Although the proposition had a significant influence on both Public Law and Private Law in western world,it cannot cover the parent-child relationship.After the formation of the theory of formative right,people began to realize more and more non-equal relationship field in private law.Since the discovery of the dependency of the labor relationship,the house lease relationship,contractual relationship with a condition whose realization depends on the will of the contractual parties,the relationship of adhesion contract and even the conception of oppressive clause(clausola vessatoria) have been discovered gradually.Consequently,a set of new legal systems have been established to adjust these non-equalizing relationships and to query the truthfulness of the traditional statement that civil law adjusts the relationship between civil subjects with equal status.The protective nature of subjection relationship decides that the word "subjection" here is not equal to "humiliation".
