英文摘要	流动妇女生育保险问题,是指我国一些地方性法规以户籍为标准,将流动妇女排除在当地生育保险制度之外,致使流动妇女不能享受生育保险待遇的制度性歧视问题。而引发流动妇女生育保险问题的制度性原因,在过去,主要是由于国家生育保险立法的缺失。2010年出台的社会保险法从国家立法层面上作出了生育保险不与户籍挂钩的刚性规定。人们期盼,随着社会保险法的实施,流动妇女能够真正平等地享受国家法律所规定的生育保险待遇。; The problem of migrant women maternity insurance means that some local laws and regulations excluded the migrant women from the local maternity insurance by the residence standard.And which results the institutional discrimination that the migrant women can not enjoy the maternity insurance benefit.The problem of migrant women maternity insurance should arouse great concern by scholars of social laws.It is the lacking of national maternity insurance legislation that caused the problem of migrant women maternity insurance.It is an institutional reason.For the voice of migrant women should be included in the system of maternity insurance",Social Insurance Law"has responded to the issue of migrant women maternity insurance,and has regulated that maternity insurance is not linked with the residence from the state legislative level.With the implementation of the "Social Insurance Law",migrant women will be equal the rights to participate in the national maternity insurance and to equal enjoy maternity insurance benefits under the law.
