| 英文摘要 | 《海峡两岸经济合作框架协定》(ECfA)是区域贸易协定(rEgIOnAl TrAdE AgrEEMEnT,rTA)实践和两岸经济合作机制的重要发展。ECfA在名称、主体、调整对象、基本原则、执行机制等方面显示出鲜明的“两岸特色“,不仅不同于一般的主权国家之间的rTA实践,也不同于中国rTA实践特殊形式中的内地与香港、澳门之间的CEPAS。ECfA对于实现两岸经济合作关系的正常化、法制化具有重要的里程碑意义,其对中华台北rTA实践发展可能具有的法律意义也值得关注和研讨。; The Economic Cooperation Framework Agreement across the Taiwan Strait(ECFA) is an important development of the practice of regional trade agreements(RTAs) and of economic cooperation across the Strait.ECFA shows its clear "cross-Strait characteristics" in the aspects of its title,subject,object,basic principles,and enforcement mechanism,etc.It is not only different from the general practice of RTAs between or among sovereign States,but also from the special form of China's RTA practice,namely Closer Economic Partnership Arrangements between the Mainland and Hong Kong or Macao.ECFA is a milestone in realizing the normalization and legalization for the economic cooperative relations across the Strait.Its possible legal implication for Chinese Taipei's RTA practice is worth considering and researching.; 司法部2009年度国家法治与法学理论研究重点课题“两岸经济合作框架协议研究”(09SFB1008) |
