英文摘要	法需要获得道德上的正当性,这是法哲学的基本判断,是和谐法律文化生成的必要条件,也由道德话语在人类实践理性结构中的特殊地位所决定。这种正当性不能被转化为知识含义上的真实性,它的基础不是某种以“实然“形态存在的客体,而是实践理性主体自身设立的“应然“规范。以此为基础,在以恰当之理性预设为依托的民主立法程序中,抽象的实践理性主体向现实的平等参与主体过渡,形式性的普遍道德规范也为实证法律制度注入具有时代特征的实质正当性。; Moral legitimacy is necessary to law.This fundamental judgment of legal philosophy is determined by the irreplaceable position of morality in the structure of practical reason.This legitimacy is a basic factor of harmonious legal culture.Legitimacy of law is not the truth in the sense of epistemology,its foundation is not the object exist as being but the norm formulated by practical reason.Through the democratic legislative procedure based on rational principle formulated in advance,the actual participators apply and enrich practical reason and the universal but formal moral norm brings the substantial legitimacy to positive law.
