英文摘要	“人“是法学研究与法律实践最根本的目的与依归。受哲学与经济学的影响,西方法律中“人“的形象发生了由近代法律中“强而智“的“理性人“到现代法律中“弱而愚“的“有限理性人“的变迁。在这个变迁过程中,既有传承也有超越,传承的是对人性尊严的肯定,超越的是对自治、自利与利益最大化的理解与认知。中国现行法律体系中“人“的形象兼具“理性人“与“有限理性人“的特点,这是移植西方法律制度文化与继受中国自身传统两方面因素综合作用的结果。中国的“人权条款“为解决由于中国法律中“人“的形象“跨越式发展“而带来的问题提供了规范依据,《宪法》的解释者与适用者可以借助解释技术对该条款进行开放性解读,以维护法律的稳定与权威、保障人性尊严,满足时代变迁的要求。; The fundamental purpose and the final object of law research and its application is person.With the influence of philosophy and economics,the image of person in Western law has changed from rational person to limited rational person.The change is both successive and innovative,which means the latter image inherited the former's point that human dignity should be respected and altered the understanding of autonomy,self-interest and maximum benefits.The person's image in China's law is both rational and limited rational,which is the result of transplanting Western law and legal culture while inheriting China's legal tradition.The Human Rights Clause in China's Constitution provides the rule for the questions which are brought by the fast paced development of the change in person's image.The interpreter of the Constitution can explain this clause with opening and growing attitude in order to keep the Constitution's authority,protect human dignity and meet the demand of changing times.; 中国法学会部级课题“比较法视野中的中国《宪法》未列举权利研究”(项目编号:CLS-D0921)的阶段性成果
