| 英文摘要 | 针对人们对中国经济特区授权立法存在意义提出的质疑 ,通过对经济特区授权立法与上位法、世贸规则、政策、政府及利益团体等若干关系的分析 ,指出中国经济特区授权立法仍有其存在的意义和价值 ,问题是经济特区授权立法主体如何在现行立法体制规制范围内 ,因应时代发展的要求 ,谋求其发展的空间 ,使经济特区授权立法更上新台阶。经济特区授权立法主体充分发挥授权立法权特有的优势与功能是解决这些问题的有效途径和措施 ,而利益制衡机制的设置则是使经济特区授权立法利用自身优势拓展立法空间得以顺利进行的保证。 【英文摘要】In response to suggestions that the Special Economic Zones in China no longer need to have the delegated legislation, the present article conducts analysis on the relationships between delegated legislation for the Special Economic Zones and its upper-class laws, between the rule of World Trade Organization(WTO) and policy, and between the government and interested parties. As a result of this analysis, the author points out that there is still a need for delegated legislation for the Special Economic Zones , while the real issue that needs to be addressed is how the delegated legislation bodies in the Special Economic Zones adapt to the changes of our time , expand the space for their development , and thus bring the work of delegated legislation of the Special Economic Zones onto a new stage. The full utilization of these unique privileges and functions by the delegated legislation bodies in the Special Economic Zones is the effective measure to solve these problems , and the installation of checks and balances is the necessary step for the smooth implementation of this delegated legislation.; 教育部人文社会科学研究项目 (重点项目 );立法权的配置与运作研究 (02JAZ820007) |
