中文摘要	民事诉讼级别管辖是最高法院作为民事案件初审法院的规定,带有超职权主义色彩,存在着缺失。应明确界定中级法院受理一审民事案件;高级法院作为上诉法院只受理二审上诉案件或三审上诉案件,允许当事人越级上诉到高级法院,高级法院可以进行事实审也可以进行法律审,不受制于当事人上诉时声明的部分;最高法院仅作为三审上诉法院,受理针对重大法律问题提出的上诉,采取书面审理方式,同时为当事人三审上诉设定条件,实行上诉许可制。The provision that the grade jurisdiction of civil procedure law especially the Supreme Court acts as the first court of the civil cases has extreme ex - official color, and has many imperfection. The first trial of the majority of the civil cases should allocate to the grassroots court, also should definitely define that the intermediate court accepts the first reviewing civil cases; the superior court acts as the appeal court, doesn＇t accept the first reviewing cases, only accepts the appeal cases of the second reviewing and the third reviewing; allow the parties appeal to the superior court directly, the superior court should examination generally the appeal cases of the second and the third reviewing , including the fact review and the law review but not subject to the declaration of the appeal of the parties; the supreme court only acts as the appeal court of the third reviewing cases, accepts the appeal to the important legal problems, adopts the written review form , at the same time sets up the terms for the third review of the parties, practice the appeal license system.
