中文摘要	指出在司法实践中,大量的合同纠纷案件需要进行合同解释,但因我国《合同法》对有关合同解释问题的规定过于概括和模糊,导致合同解释的随意性很大,这对案件的公正审理和确保司法公正不利。在合同解释中,法官及仲裁人员应坚持以"理性第三人"为判断分析的立场和标准,以公平、正义及诚实信用等原则作为分析判断的基本原则,并正确运用合同解释的方法。试从一个案例入手探讨司法实践中的合同解释问题。; In the judicial practice,many contract disputes need contract explanation.However,the present Contract Law contains the contract explanation generally and ambiguously,thus generating great spontaneity.It will count against the justice of cases.In the explanation,judges and arbitrators should act as the rational third party in analysis,being impartial,righteous,and honest and trustworthy,and use the methods correctly.This paper tries to study contract explanation from a valid case.; 【作者单位】集美大学文学院；【作者英文名】ZHENG Ying-ming(College of Chinese Language and Literature,Jimei University,Xiamen Fujian 361021,China)
