中文摘要	自上世纪80年代初,我国在工程建设领域拉开推行和发展招投标制度的序幕,发展至今已有30年,招标投标法律体制已基本建成。但由于我国目前仍处于市场经济初级阶段,行政监督不力,各项制度有待完善,所以招标投标市场还存在诸多不良现象。为了进一步规范招投标活动,促进招投标市场健康有序发展,国务院法制办公布《招标投标法实施条例(征求意见稿)》,并公开征求意见。围绕该征求意见稿中的招标范围、资格预审、评标规定、监督管理4方面的内容进行了全面分析,并对某些条文的不足之处提出了修改意见。; since the early 1980s, the bidding system has developed for almost 30 years in construction field in China. The legal system of bidding has been setting up. There are still illegal situation in bidding market because of initial stage of market economy and lack of administrative supervision. The legal office of state department issued implementation regulation of bidding law 《draft for soliciting suggestions》 in order to regulate bidding activities and improve sound development of bidding market. This paper analyzes the issues of bidding scope, prequalification, evaluation and supervision in the regulation and proposes amendments.
