中文摘要研究目的:探究土地流转过程中出现纠纷的原因,并提供解决方案。研究方法:案例研究与理论分析。研究结果:土地流转纠纷的根本原因在于土地投入存在的资产专用性问题限制了承包户退出流转的自由,但在现行土地制度与法律制度下,保障承包户自由退出权的"政治保护逻辑"与尊重投资者权益的"契约保护逻辑"又构成了难以调和的矛盾。研究结论:承包地互换机制能够在满足承包户退出流转自由的同时,保护投资者不会遭受专用性投资损失,成为应对土地流转纠纷的一种有效解决方案。; Given the dispute of land circulation contract always renders the existing land circulation arrangements unstable, this paper aims to explain the cause behind this kind of dispute and provide a solution. It is argued in this paper that the critical issue is that asset specificity restricts contractors' freedom of withdrawing land circulation. Yet in the current land administrative system and legal system, there is an irreconcilable conflict between the "logic of political protection" guaranteeing contractors' freedom of withdrawing land circulation and the "logic of contract protection" securing investors' interests. Based on case studies and theoretical analysis, this paper finds that contracted land interchange mechanism guarantees contractors' freedom of withdrawing land circulation while protecting investors from the specific investment losses, and thus is an effective solution to land circulation disputes.
