| 中文摘要 | 通过西南地区D县的调查发现,当事人接受调解的原因是多方面的,其中既有当事人自身的原因和其他调解参与者的影响,又有强制性因素的影响,还有调解的空间性及技巧等,这些因素都成为促使当事人接受调解的主要原因。明确当事人接受调解的主要原因,不仅能够在司法实践中更清楚地认识到调解的作用,同时也能让我们更进一步反思调解,从而构建一个更为良好健全的法院调解运行机制。; Through surveying the southwestern region D County,we have found that there are many reasons about the litigants accepting the mediation.Those include both litigants for their own reasons and the impact of other participants in the mediation.Otherwise,there are mandatory factors,as well as spatial and mediation skills etc.These factors have become the main reason for the litigants to accept mediation.Making the main reason for the litigants to accept mediation clearly,not only make us more clearly to recognize the role of mediation in judicial practice,but also allow us to further reflect on mediation,and build a more favorable court mediation sound operational mechanism. |
