中文摘要	通过规范分析,可发现我国宪法呈现出一种倾斜性的实施形态;而从比较宪法角度来看,我国宪法的实施方式在历史类型学上较接近于欧陆国家的近代宪法,所不同的是作为宪法实施"第一责任者"的国家立法机关倾向于采取自我谦抑主义的立场。这种实施形态是由多种原因促成的,在现行宪法作为转型期宪法完成其转型之前,难以完全改变。但宪法转型已然发生,从现下即开始着手健全违宪审查制度,至少在现有制度框架内部整合出一种"合宪性审查优先移送机制",不仅至为切要,亦大可裨益于宪法转型。; It is not difficult to find that implementation of our constitution is of imbalance by a normative analysis; from a comparative perspective,the mode of implementation of contemporary constitution is close to that in early modern era in western history. However,the legislative branch in our country which is regarded as the first person responsible for implementing the constitution has taken a self- restraint attitude. This mode is formed by different factors,and except the contemporary constitution has fully developed,the status quo cannot be changed. Since in the transitional period,it is necessary to develop a kind of Constitutional review institution,at least integrate a transmitting institution in the existing frame,which is also helpful to constitutionalist transition.
