中文摘要	中西学术界探讨"文化"的定义向来聚讼纷纭,莫衷一是。文化包含器物、制度、理念三个层面,但以价值观念为其核心构成。文化决定着我们的生活方式,也决定着我们的法律和政治体制。套用贺麟先生的文化体用观,文化之与法律,也是体和用的关系,文化是体,法律是用。体用割裂,文化与法律不能相谐,则文化必然失化,法律也必然失律。故欲探讨法律之现代化,不能不深究法律背后之文化因素。; The definition of culture has long been a matter of discussion in Chinese and Western academia.This article adopts the view that culture contains three levels of implements, systems and ideas, but stresses that values are the core ingredient of culture. It is argued that culture determines the way we live, as well as our law and political systems. According to He Lin's Essence and Appearance theory of culture,the relationship between culture and law can be also described in terms of essence and appearance: culture is the essence and law is the appearance. Once essence and appearance separate and culture and law cannot coordinate, the culture is bound to lose its function of civilization and the law bound to fail in regulation. Therefore, to discuss the modernization of law, it is necessary to first understand the cultural factors behind the law.
