中文摘要 | 随着《城乡规划法》的出台,实施城乡统筹的规划管理得到了空前的重视,但由于城乡二元体制等体制性障碍仍旧存在,加强农村地区规划管理在实施层面还存在众多的困难。本文分析了北京地区农村集体建设用地建设的现状,指出农村集体建设用地建设出现诸多问题,其根本原因是体制性矛盾造成的,除了城乡二元的土地制度构成了最大的制度性约束外,还存在各层级责、权、利结构性失衡和规划挤占农村发展空间等制度性问题。同时,加强农村规划管理还面临土地确权不确定因素多、历史遗留包袱重和行政成本高等具体实施困难。最终提出,应按照与体制性矛盾的解决进程相适应和与社会经济发展水平相适应的原则稳步推进农村规划管理,并提出全面推进土地确权、加强村庄规划指导以及开展项目管理试点等具体实施建议。; By the Urban-Rural Planning Law of the People's Republic of China to be promulgated,how to implement Urban-Rural Plan has been of great importance. As a result of dual society,improving planning administration of rural area was faced with many difficulties. This paper analyzed the current situation of rural collective construction land use in Beijing,and put forward that the problems of rural collective construction land are basically caused by system conflicts. In addition to the essential reason of dual land use system,there are still others such as imbalances between responsibilities,rights and benefits,and rural development space is reduced by planning system. There were accumulated heavy burdens. It will be uncertain to ascertain land property rights. Administrative costs will be higher than before. It's proposed that rural area planning administration should be coordinated with social system reform and development of society and economy. Detailed proposals such as ascertaining land property rights,strengthening village planning guidance and starting pilot projects are put forward as well. |
