| 中文摘要 | 新媒体的内容规制是政府公共政策和传媒业面临的重要课题。欧盟回应数字化和产业融合的挑战,将IP电视、互联网广播电视、播客广播、手机电视和移动多媒体广播等新兴视听节目服务纳入《视听媒体服务指令》的规制框架,提出了依据服务性质来区分内容规制程度的新思路。本文从欧盟新媒体内容规制政策的演进入手分析《视听媒体服务指令》,探讨了规制对象的界定、规制原则的确立、以及公共利益与产业利益冲突所造成的规制困境。; The content regulation of new media is an important problem which government public policy and media industry have to deal with.In order to respond to the challenge of digitalization and industrial convergence,Internet broadcasting,IP TV,mobile TV and other new media services are placed into the regulatory framework of the Audiovisual Media Services Directive and are regulated on the basis of the characteristic of the media services in EU.This article outlines the regulatory process of the EU new media policies and analyses the Audiovisual Media Services Directive,including the object of regulation,the principle of regulation,and the plight of regulation. |
