| 中文摘要 | 本文回顾了风景名胜区国家立法的历史进程及其核心行政法规的演变,分析其在建设法制社会背景下,从行政指令转向立法过程发生了对原有环境价值背高的问题,分别从风景名胜区的设立、体系设立与规划制度、管理制度三个主要方面进行论述。本文认为价值调适可分为二步,第一步是建立涵盖风景名胜体系规划的法律,改变现有行政法规效力级别低的现状;第二步是加强环境与资源保护法律体系内关于遗产地(包括风景名胜区、自然保护区、森林公园等)保护区的立法研究,同时从资源整体保护角度改革行政体系设置,达到立法与法律适用的统一。; This paper reviews the historical process of national legislation on scenery site and the evolution of main administrative regulations.Analyzing the environmental value deviated from the shift of the administrative command to the legislative process when running the country bycombining the rule of law,respectively,from the establishment of scenery site,the system set upwith the planning system,management system to address three main areas.This article holds that the value can be divided into the two-step adjustment,the first step is to raise the administrative regulations to law,changing in the effectiveness of existing administrative regulations,the status of low-level;the second step is to strengthen the Legislative Studies of heritage sitesincluding the scenery sites,natural reserves,forest parks,etc.Meanwhile,reform of administrative system should integrate the legislature and the law applicable. |
