| 中文摘要 | 代建制的运作机理与工程总承包、项目管理模式较为相似,然而经分析比较发现,与代建制最相似的是传统模式。代建制在传统模式基础上的最大创新,在于业主职责的分解和分配,以及合理构建投资人、使用人、代建人之间的合约关系。因而保障代建单位建设期项目法人地位是代建制成功实施的关键,而这有赖于相关法律法规的完善。; The Agent Construction Method (ACM) is similar with the General Contracting Method and Project Management Contracting Method in mechanism. However, it can be concluded through comparison that ACM is actually most similar with the traditional method. The primary innovation of ACM beyond the traditional method is the break and reallocation of owner's responsibility which is expatiated in the agreement among the buyer, the user and the agent contractor. So it is highly important to ensure the rights of the agent contractor as the owner in the construction phase, thus, some related laws and regulations need to be amended.; 北京市科学技术委员会博士生论文资助专项(ZZ0615) |
