中文摘要听证制度引入中国的公共决策十余年,被视为决策民主化的重要举措;在实践中却屡屡被公众置“疑走过场”。本文辨析了听证的制度内涵,指出它作为裁决前听取当事人意见的过程,其核心价值是程序正义;听证效果出现偏差,源于将其民主价值扩大化到代议民主的决策地位,却恰恰忽略了对其程序正当性的追问。本文提出听证制度的程序正义三方面原则,并将细则归纳为十三个问题,以2006年北京市出租汽车调价为例作了实证分析。文章最后强调了公开,而不是民主的价值,有利于促进公正裁决者的产生,实现听证的程序正义。; Public hearing has been introduced into Chinese government as an important system to guarantee democratic decision-making. While it’s often been doubted when put in practice. This article analyzes the implications of public hearing, stressing its sense of participation in democracy. The essential value of public hearing is procedural justice which may be summed up in three main principles. The first is the principle of equal opportunity, including equal access to public hearing, equal rights of expression, and priority for the disadvantageous. The second is the principle of rational dialogue on the basis of evidence, including single object principle, principle of evidence, counterview, and complete information. The third is the principle of autonomous judgment, including autonomous procedure, fair judge, and feedback on the results. This article resolves these principles into thirteen questions, taking as case study the public hearing of car rental adjustment in Beijing in 2006. Finally, the article concludes that publicity rather than democracy is more crucial to the practice of public hearing in China.
