| 中文摘要 | 网络服务商可以分为网络内容提供服务商、网络连接提供服务商和网络平台提供服务商。网络内容提供服务商应对其提供的内容负责。网络连接提供服务商不应承担帮助犯的责任,由此出发,相关司法解释存在疑问。网络平台提供服务商的行为通常属于中立行为的帮助,没有制造不被法所容许的危险,不宜作为帮助犯处罚;为P2P提供软件及相关服务的经营者的行为通常属于正常的业务行为,不宜认为行为本身的危险达到了值得作为帮助犯加以处罚的程度,宜否定帮助行为的存在,否定帮助犯的成立。; Internet Services Provider(ISP) can be divided into Internet Content Provider(ICP),Internet Access Provider(IAP) and Internet Platform Provider(IPP).ICP should be responsible for what contents it provides,and IAP can't be convicted as an auxiliary criminal.It follows that the relevant judicial interpretation is questionable.As to the IPP,what it did should not be regarded as an auxiliary criminal,since the help it provides usually belongs to a neutral behavior without the danger impermitted by law.The behavior of any companies who provide P2P softwares and other related services usually belongs to normal business operation,and it is improper to consider such a behavior as a danger which should be convicted insomuch as an auxiliary criminal to be punished.The proper way is to deny that their help behavior is guilty and they are auxiliary criminals. |
