中文摘要	日本刑法第65条第1项规定的是违法身份,第2项是责任身份;参与违法身份的,只能构成以此身份为要件的罪名的教唆犯或帮助犯,参与责任身份的,对于非责任身份者,应以非责任身份者所对应的罪名定罪处罚。贪污罪的主体国家工作人员属于责任身份,而受贿罪的主体国家工作人员属于违法身份,因此,国家工作人员指使其不具有国家工作人员身份的亲属收受财物的,国家工作人员构成受贿罪的间接正犯,其亲属构成受贿罪的帮助犯。普通公民伙同邮政人员私自开拆他人信件的,普通公民构成侵犯公民通讯自由罪,而邮政人员构成私自开拆邮件罪。刑讯逼供罪的主体司法工作人员属于责任身份,非司法工作人员伙同进行刑讯逼供的,不以刑讯逼供罪定罪处罚。; The Article 65,paragraph 1 of Japan's Penal Code regulates the illegal identity,while the paragraph 2 regulates the responsibility identity.One that participates in illegal identity,can only form the abettor or help criminal who takes this identity as the important document of the charge.However,one that participates in responsibility identity,comparing to non responsibility identity person,should be declared guilty and punished according to the charges of them.National staff members,the subject of the corruption are responsibility identity,while the subject of the bribery is the illegal identity.So,national staff member,who instigates his relative without national staff member's identity to receive property,makes the indirectly of bribery crime,his relative commits the help of the bribery crime to make.The ordinary citizen opens others' letter without permission in collusion with postal personnel,the ordinary citizen commits the crime of infringe the freedom of correspondence,and postal personnel commits the crime of opening mails without authorization.Law-officer,the subject of the crime of extort confession by torture belongs to the responsibility identity;while the others who aren't law-officer,can not be declared guilty and punished by the crime of extort confession by torture.
