中文摘要	通过参与式观察调查,在分析杨村人民法庭的法庭概况、法庭法官、法庭运作基础上,由法庭所处的农村社会特点和人民法庭的具体功能所决定,我们将人民法庭的司法定性为"乡土司法"。司法主体的类型是非职业化、大众化的法官;法官倚重的是自己积累的司法经验;法官要以便民的原则来解决纠纷,又要以务实的方式来维护稳定,还要以得力的手段来树立和维护政府的权威;法官须追求"法律效果和社会效果"以及"情、理、法"的统一。; With participant observation we got clear knowledge about the judges,the judicial process and other basic information of the people's tribunal of Yang Cun village.As Chinese rural society's characteristics and this justice's specific functions,we define justice of the people's tribunals as rural justice.The subjects of rural justice are non-professional judges who rely on their own judicial experience and public participation,and in rural China who should settle disputes with offering greater convenience to the people,maintain social stability in pragmatic approach,establish and safeguard government's authority in effective means.In short,the judges should pursuit the unity of legal effect between social effect and the harmony of divine justice,state law,and human feelings.
