| 中文摘要 | 同一债权既有保证担保又有物的担保时,应当依据保证的类型及物上保证人的种类分别确定何者先予实行。债权人抛弃担保物权或保证债权会使得保证人或物上保证人免除责任。共同保证人之间、物上保证人之间应当对债务进行相应的分担并享有追偿权与代位权。; If the same debt is secured by both guarantee and security on property, it depends on the type of guarantee and the kind of security that the creditor should realize which right first of all. If the creditor gives up guarantee or security on property, the surety or security will be exempt from corresponding liability. The debt should be contribued in co-suretyships or securities, then they have the right of indemnity and subrogation. |
